Special Conditions applicable for participants of our holidays
The services of In Luxe Travel France are sold exclusively by professionals possessing a valid immatriculation issued by the Department of Tourism (No: IM-016-140001). By signing up to any service listed on our website, you agree to the GENERAL TERMS OF SALE as defined by the decree of 15th June 1994, in accordance with article 31 of the law of 13th July 1992 as well as our special conditions.
Travel plans, confirmation of reservation, travel contract
Each request made by the customer will result in a very careful studied quote sent out by In-Luxe Travel France. This quote is just an indication and has no contractual value.
Written confirmation and price setting for the trip are part of a sales contract between In-Luxe Travel France and the customer, a copy of which is given to the customer. This contract covers the main characteristics of the stay or tour, sale conditions as well as eventual relative observations of the chosen holiday.
By signing your travel contract and the present conditions, the customer agrees to have understood the characteristics of the holiday, of which he will have received details.
Booking
Every booking must be accompanied by the payment of a deposit amounting to 30% of the total cost of the holiday. If the deposit is accepted, the remainder of the total price must be paid to us no later than 30 days before departure, and without reminder being issued by us.
> If the balance of the holiday is not paid in full 30 days before departure, In-Luxe Travel France reserves the right to cancel the booking without refund.
> If the booking is made 30 days before departure the total price of the holiday must be paid in full at the time of booking.
> For bookings made less than 15 days before departure, only payment by bank transfer will be accepted.
> If, 5 days before departure, you have not received your travel documents, it is your responsibility to inform us so that we may forward them to you in time.
Cancellation
By the client
Cancellations will not be considered unless they are made in writing and sent by recorded delivery (including acknowledgement of receipt) to our office. The date of receipt of this letter will determine the date of your cancellation.
If, for whatever reason, you have to cancel your journey, you will be reimbursed subject to the following deductions:
> 30 days before departure: administrative fee of 50 euros per person will be retained
> between 30 days and 21 days before departure: 25% of the total price of the holiday will be retained
> between 20 days and 8 days before departure: 75% of the total price of the holiday will be retained
> less than 8 days before departure: 100% of the total price of the holiday will be retained
By the vendor
The special conditions may force In-Luxe Travel France to cancel a trip in case of circumstances outwith our control: social unrest, strikes, bad weather, and any situation which would put participants in jeopardy. In such cases, participants will be fully refunded but will not be able to claim compensation.
Liabilities
In-Luxe Travel France cannot be held responsible for failing to carry out services laid out in the programme in the following cases :
– delays due to earlier transportation on land, rail or air not organised by In-Luxe Travel France having led to the late arrival or absence of the customer at the departure point for the holiday, for whatever reason, even in extreme situations.
– modification of timetables or itinerary, unavailability of services laid out on the reservation, etc, as a result of events beyond our control, assimilated to extreme situations (strikes, security measures, technical incidents etc.)
– lost of luggage.
Supplementary Insurance
At the time of booking, you are strongly advised to take out a supplementary insurance policy, covering the risk of cancellation (reimbursement of withheld charges in certain cases, notably illness, accidents, death etc), the cost of repatriation, hospitalisation and medical expenses. From 30 days before departure, the cost of insurance is due and cannot be refunded. Insurance does not come into effect until 30 days before departure and only if your holiday has been paid in full. Therefore any cancellation charges incurred more than 30 days before departure are not covered by the insurance.
Modification of booking by the client
Any modification made to your journey will incur a charge of 50 euros per person. If an amendment to the date of departure or return occurs less than 20 days before departure, it will be considered as a cancellation of the entire trip. In all cases, the customer must convey and alterations to be made in writing. Any service which is not used will not be refunded.
Modification of booking by the vendor
Circumstances out with our control may dictate that alterations have to be made to the contract by In-Luxe Travel France. We would inform our clients as soon as possible of any such change.
If the client transfers the contract to an assignee less than 7 days before departure, the conditions of modification and cancellation will apply.
Modification of an organised tour by the vendor
In-Luxe Travel France reserves the right to alter the arrangements of its tours, and to change – particularly in the case of bad weather or other unforeseen circumstances – accommodation or, if circumstances dictate, to exchange one itinerary for another, without participants being entitled to compensation.
Complaints and disputes
Any complaint regarding our holidays must be made within 15 days of the date of return, by sending a letter and any justifying evidence by recorded delivery (including acknowledgement of receipt) to: In-Luxe Travel France, 41 rue de l’Eglise, 16100 Javrezac, France.
Any dispute arising from the conditions listed herein falls under the jurisdiction of the Tribunal de Commerce de Cognac. Only French law is applicable.
